Hi, thank you for writing on this subject. I have been looking for something like this and your blog helps me a lot to understand the topic better. Waiting for your next post.
Pro se litigants especially need to read and study the laws and cases for their particular circuit and any adopted circuit opinions they can use to fight for their rights. Pro se litigant better take their case very seriously because no one will respect or care about their case like they do, sometimes a litigant will be be treated like they are ignorant or insignificant and at times have that assumption and belief used against them, fight it. Remember litigants are just a number in a load of cases in the courts system and their pain or injustices are not the courts concern just the facts and laws that PROVE their pain and injustices from a legal standpoint. I have personally learned the ONLY thing that speaks to a court is the laws, so try your best to learn them. I have an appeal in the 11th circuit right now.

I have guardianship of my 2nephew/1niece… DCF has left them with me.. but, i am trying to get legal custody of them, and DCF won’t listen to my concern’s.. Mother is a pill popper, father is in prison, (due to come out soon).. Can i get legal custody of the kids??
Your comment has been forward the Attorney that recorded this show. Thank you for your comment. Moderator
Dear Irasema,
There are at least three alternatives to resolve your issue, as follows: private dependency petition, guardianship of a minor or temporary legal custody. A dependency petition requires, that you allege some type of abuse, abandonment or neglect by the parents. A guardianship of a minor does not require consent of the parents. However, the parents would have to be served the guardianship petition. There would also be a hearing if the parents object or do not respond. The guardianship petitions are filed in the Probate/Mental Health Division and require annual reports to the court that are not required with the other legal methods to achieve legal custody. A temporary legal custody petition is with the consent of both parents and can be revoked by either parent. Upon revocation, either parent could obtain the children who are in your care without your consent. You should always consult with an attorney, especially if DCF is not willing to initiate dependency proceedings and the children are or could be at risk of harm with a parent or parents.
Child support helps all of us a great deal within my life, would not be for it then my kids dad would not fork out
